Argentina asks NY appeals court to block payouts for debt holdouts

Argentina is urging a US appeals court to reverse an order requiring the country to pay $1.33 billion to creditors who did not participate in its two debt restructurings, a legal case that could have huge ramifications for global debt markets.

Lawyers for Argentina's government said in court papers filed late on Friday that a trial judge was "wrong to ignore the chorus of voices" who opposed his November order on payments to so-called "holdout" creditors.

Those payments, to a court-controlled escrow account, would threaten the service of $24 billion in restructured debt, Argentina's lawyers wrote in papers filed in the 2nd U.S. Circuit Court of Appeals in New York.

"There is no authority permitting a US court to order a sovereign to bring its immune assets into the United States in order to 'turn over' or distribute them to its creditors," lawyers for the Argentine government said in the 69-page filing.

Lawyers representing Argentina confirmed that President Cristina Fern?ndez de Kirchner plans to send a bill to congress to allow a new debt swap under the same conditions it was done in 2010.

On Friday night, the US Government backed Argentina?s stance filed on the New York Court of appeals. ?By restricting the immunity that the properties of a foreign state possess excessively, the decision not only contradicts previous rulings by this court, but could could affect US foreign relations and jeopardize goods of the US Government,? the office of the US Attorney General

The Associated Press now unveils its postseason awards the night before the Super Bowl, weeks after most people have stopped caring about the winner.

So we announce ours immediately after the regular season ends.

At a time when you still actually are interested in these matters and not, you know, you?ll win the Super Bowl, here are the men who, in our opinion, deserve special recognition for their accomplishments in the freshly-completed regular season.

Offensive Rookie of the Year.

Winner: Russell Wilson, Seahawks.

Runner-up: Robert Griffin, III, Redskins; Andrew Luck, Colts.

Honorable mention: Alfred Morris, Redskins; Doug Martin, Buccaneers.

The AP award likely will go to either of the top two picks in the draft, but it shouldn?t.? Wilson entered the league short on height and long on smarts and talent and determination.? Russell Wilson commanded the No. 1 spot on the depth chart in Seattle, beating out big-money free-agent Matt Flynn and incumbent starter Tarvaris Jackson, and Wilson then began to prove week-in and week-out that he is as good as his more famous counterparts who were selected much higher.

Despite the 11-5 record for the Colts, Luck had too many turnovers (contributing to a mediocre passer rating of 76.5), and Griffin missed a game and crunch time in another due to an inability to avoid contact.? While Luck broke Cam Newton?s rookie passing yardage record, Wilson tied Peyton Manning?s record for touchdown passes by a rookie ? and Wilson showed that he could run the ball effectively (489 yards, four touchdowns) without getting hit or, in turn, hurt.

The best news is that the three rookie quarterbacks all made it to the playoffs, and they?ll all make their postseason debuts on the same day.

Defensive Rookie of the Year.

Winner:? Luke Kuechly, Panthers.

Runner-up:? Janoris Jenkins, Rams.

Honorable mention:? Bobby Wagner, Seahawks; Lavonte David, Buccaneers; Casey Heyward, Packers; Harrison Smith, Vikings.

The ninth overall pick in the draft, Kuechly led the NFL with 164 tackles, finishing 10 short of the rookie record set in 2007 by Patrick Willis.? Kuechly also had 10 games with 10 or more tackles.? In Week Five, he slid from outside linebacker to the middle, where he participated in every snap on defense for the rest of the season.

Jenkins, a second-round steal, instantly became a dangerous cover man and return specialist.? He could soon be one of the best cornerbacks in the NFL.? Some may say he already is.

Coach of the Year.

Winner:? Bruce Arians/Chuck Pagano, Colts.

Runner-up:? Leslie Frazier, Vikings.

Honorable mention:? Mike Shanahan, Redskins; Pete Carroll, Seahawks; John Fox, Broncos; Mike Smith, Falcons.

The best coach routinely is determined based on a team?s actual performance relative to its expected performance.? This year, no team exceeded expectations more than the Colts, who won 11 games a season after winning only two.? Pagano and Arians combined to generate a wild-card berth despite Pagano?s three-month absence due to leukemia treatments, as part of a run that included seven come-from-behind wins.

Frazier and the Vikings improved their win total by seven, going from 3-13 to 10-6 and a playoff berth secured on the last day of the season against the Packers.? Shanahan and the Redskins reeled off seven straight to secure the NFC East after Shanahan seemingly threw in the towel on the 2012 season.? (And all future coaches whose teams are 3-6 after nine games will do the same.)

In all, three of the six worst teams from 2011 have vaulted to the playoffs only one year later, providing real hope to every other non-playoff team, in 2013 and beyond.

Comeback Player of the Year.

Winner:? Peyton Manning, Broncos; Adrian Peterson, Vikings.

The two greatest comebacks in NFL history came in the same year.? For Manning, the return from multiple neck surgeries was unprecedented.? For Peterson, his performance following a Christmas Eve 2011 ACL tear was equally stunning and unlikely.? Both deserve the recognition, and it?s only fair for them to share it.

It?s also only fair that there be no one else mentioned as the runner-up or otherwise.? Manning and Peterson are in their own class on this one, and no one else comes close.

Executive of the Year.

Winner: John Elway, Broncos.

Runner-up: John Schneider, Seahawks.

Honorable mention: Ryan Grigson, Colts; Rick Spielman, Vikings; Les Snead, Rams.

Elway wanted Peyton Manning in large part because it gave Elway cover to dump Tim Tebow.? The gamble (in light of Manning?s recent medical history) paid off in a major way, making other teams (like perhaps the Texans) wish they?d done more to land one of the greatest players in NFL history.? Though making the move for Manning is enough on its own, hiring coach John Fox in 2011 after a two-win season in Carolina, picking linebacker Von Miller in last year?s draft, and not giving up on Knowshon Moreno are icing on a cake that Elway has been masterfully baking for the past two season ? even though Elway entered the job with fry-cook credentials.

Schneider found a quarterback who could become one of the best current signal-callers in the league in round three of the draft, five spots after the Jaguars picked a punter.? Schneider likewise rolled the dice in round one on Bruce Irvin, a controversial pick who panned out as a rookie.? Throw in linebacker Bobby Wagner in round two and the prudent decision to re-sign Marshawn Lynch, and Schneider had a lot to do with the team?s unexpected success in 2012.

Grigson quickly turned around a talent-challenged roster with a strong draft and the ability to make good decisions about who should stay and who should go, bringing back Reggie Wayne and keeping Dwight Freeney and Robert Mathis.? His success will make more owners opt for young, grinding scouts.

Offensive player of the year.

Winner:? Adrian Peterson, Vikings.

Runner-up:? Calvin Johnson, Lions.

Honorable mention:? Drew Brees, Saints; Marshawn Lynch, Seahawks.

Peterson is the easy and obvious choice, given that he rushed for 2,097 yards, the second most in NFL history.

Johnson set the single-season record for receiving yardage with 1,964, and Brees threw for more than 5,000 yards for the third time in his career.? Lynch?s performance gets lost in Peterson, but the guy the Bills gave away has become one of the best running backs in the league.

Defensive Player of the Year.

Winner:? J.J. Watt, Texans.

Runner-up:? Von Miller, Broncos.

Honorable mention: Aldon Smith, 49ers; Charles Tillman, Bears.

Watt was a wire-to-wire disruptive force for the Texans.? Beyond his league-leading sack total (20.5), Watt has shattered the mold for 3-4 defensive ends.? Miller is becoming one of the best 4-3 outside linebackers in the NFL, and Smith has emerged as the top 3-4 pass-rushing outside linebacker.

Amazingly, all three players are in only their second seasons in the NFL.

MVP.

Winner:? Adrian Peterson, Vikings.

Runner-up: Peyton Manning, Broncos.

Honorable mention: J.J. Watt, Texans; Aaron Rodgers, Packers; Tom Brady, Patriots; Matt Ryan, Falcons.

Many have wrestled with this one for weeks, determined to give it to Manning but keeping an open mind for Peterson.? It would have been easy to say Peterson gets it only if he sets the single-season rushing record.? It?s harder to accept that he missed it (by 27 feet) but still deserves it.

In the end, Peterson?s value to his team simply outweighs Manning?s ? even though Peyton once again has had a season to remember, shrewdly picking a talented team with an easy schedule and pushing the franchise to the top seed in the AFC.? Last year, however, the Broncos made it to the final eight without Manning.? This year, the Vikings would have been nothing without Peterson, a man who overcame a serious knee injury to become better than he ever was.

Moreover, at a time when we are more sensitive than ever before to the damage inflicted on the bodies of NFL players, Peterson earned every yard, foot, and inch that he gained.? Even the long runs came after he ran through a potential tackler.? Or two.? Or five.

Hey I have a question pictured below:

I always seem to struggle with questions like these, my understanding is we know the spacing of K-states throughout the lattice is given by

Such that the fermi wavevector divided by this spacing and multiplied by 2 due to the fact there are 2 electrons per k-state gives us the total number of electrons:

We also know that the total no. of electrons is given by the electron density multiplied by the the length of the lattice

[tex]N=nL=\frac{3L}{a}[/tex]

Where I have said the electron density is equal to 3 conduction electrons divided by the unit cell length.

Equating the expressions to eliminate 'N' I attain

[tex]k_{F}=\frac{3\pi}{a}[/tex]

Which to find the fermi energy I think I'd just use this equation but I'm not sure?

[tex]E_{F}=\frac{\hbar^{2}k_{F}^{2}}{2m_{al}}[/tex]

Where 'm_al' is the mass of an aluminium atom?

Though I'm not sure I've done this correctly... I think I may need to have the fermi wavevector divided by 2 for it to be correct - not sure why I would need to do this though.

ADA: Have employee suggest accommodations ? Business ...

Some employees think that merely declaring they have a disability means it?s up to the employer to figure out an accommodation. That?s not entirely true. The ADA accommodations process is an interactive one, requiring input from both employee and employer.

Recent case: Kathy worked for UPS for many years as a delivery driver. Then she injured her shoulder and was out for about two years on various medical leaves and workers? compensation. Eventually, she told UPS she was ready to return to work, but with restrictions.

UPS asked for medical information on her restrictions and got several conflicting reports. One showed her ready to return with a 40-pound lifting restriction. Another said she was unable to work as a delivery driver at all, but could work a sedentary job instead.

After reviewing its job descriptions (which clearly stated that drivers had to lift packages weighing up to 70 pounds on their own) and looking for other openings, it told Kathy she would not be rehired.

Kathy sued, arguing that UPS had refused to engage in the interactive ADA accommodations process and hadn?t suggested any accommodations.

The court tossed out her case. It said Kathy was also obligated to engage in the process, by suggesting potential accommodations. She hadn?t done so, while UPS had at least considered options by asking for medical information and reviewing it before rejecting her request. (Wright v. United Parcel Service, No. 11-1563, CD CA, 2012)

Final note: Be sure to track the entire accommodations process, from the moment an applicant or employee notifies you of a disability to the point when she?s either accommodated or you conclude no accommodations are possible.

Why Intel's New IPTV Service Will Do What Google, Apple, and Microsoft Can't

Apple and Google have been attempting for years to entice customers to ditch cable television for set top boxes that deliver TV shows, movies and more via the internet. For the past year or so, Intel has also quietly been working on a top-secret set-top box that could not only be better than what Apple, Google, and even Microsoft offer today, but also kill the cable industry as we know it.

This set-top box, said by industry insiders to be available to a limited beta of customers in March, will offer cable channels delivered ?over the top? to televisions anywhere there is an Internet connection regardless of provider. (Microsoft Mediaroom, for example, requires AT&T?s service, and Xbox has limited offerings for Comcast and FiOS customers). For the first time, consumers will be able to subscribe to content per channel, unlike bundled cable services, and you may also be able to?subscribe per show as well. Intel?s set-top box will also have access to Intel?s already existing app marketplace for apps, casual games, and video on demand. Leveraging the speed of current broadband, and the vast shared resources of the cloud, Intel plans to give customers the ability to use ?Cloud DVR?, a feature intended to allow users to watch any past TV show at any time, without the need to record it ahead of time, pause live tv, and rewind shows in progress.

Intel had hoped that GoogleTV and AppleTV would spur demand for Intel chips, but that having failed they poached much of Microsoft?s Mediaroom team. Much of the direction of Mediaroom came from the leadership of Jim Baldwin, who is now VP of this Intel initiative.

At Microsoft, Jim demonstrated that the technology to enable customers to watch TV over the internet using any device was feasible, but content licensing, the goals of ISP?s and bandwidth limitations previously stood in the way.

?In creating Mediaroom, we brought together key emerging technologies to create the world?s most modern television system: better video compression, higher access network bandwidth, lower cost single-chip devices, cloud computing; and added to it some great software to make it all work together seamlessly with a great user experience. Our goal was to provide technology to operators that will continue to delight consumers as the world of internet-delivered content unfolds.?

According to an Intel job posting, Jim joined Microsoft in 1997 as a part of the WebTV acquisition, and Jim has been a key architect of digital video technology for various products including the WebTV Plus, Echostar Dishplayer, DirecTV UltimateTV and Microsoft TV.

Along with hiring the right key players with the expertise needed to develop a revolutionary set-top box, Intel also has the technology to create a product unlike its competitors. Intel has been providing chips for set top boxes since the days of Akimbo, which had a similar vision as far back as 2005. Back then, though, no one had digital rights to content ? and up until now, no one wanted to risk unbundling the channels. This is clearly the biggest barrier for Intel ? but since Intel is used to betting billions on chip design, it has allocated a budget significantly larger than Apple or Google?s. While Silicon Valley measures investments in tens of millions, Hollywood often drops more than $100 million into a single movie. Intel came to the table knowing this, and so was able to negotiate the licensing agreements with Hollywood that other tech giants have never been able to.

Intel has made it clear to Hollywood they are serious about this product and dedicated to its longevity. Intel is also prepared to invest heavily in making it a success. In contrast, Apple, Google, and Microsoft have always viewed Hollywood as something of a hobby. (Steve Jobs even said as much of Apple TV). As Intel has approached Hollywood with much more dedication (and dollars), this is likely the single reason that Intel, more than any company before it, has the potential to really bring to consumers the things we have never seen in online content before, such as live sports, release schedules that match broadcast, and first episode through current libraries for video on demand.

Intel is scheduled to hold a press event at CES, where Intel will likely officially announce this new product. However, while industry insiders say a working version is scheduled to be ready for CES, it will likely be only for limited demos.

Chinese fishing boat detained in Japan: Xinhua

BEIJING (Reuters) - Japan's coastguard detained a Chinese fishing boat within Japanese waters on Sunday evening, China's Xinhua news agency said, citing the Chinese consulate general in Fukuoka, a city in southwestern Japan.

The captain of the boat, registered in the southeastern Chinese province of Fujian, and two crew members have been brought to the southern Japanese city of Kagoshima for questioning, Xinhua said.

It said the captain had admitted he was in Japanese waters.

The incident comes just months after anti-Japanese protests erupted in many Chinese cities over disputed islands near Taiwan, known as the Diaoyu in Chinese and Senkaku in Japanese. Those tensions have cooled but could flare up if stoked by nationalists on either side.

A spokesperson for the Japanese embassy in Beijing could not be reached for comment late on Sunday evening.

The Chinese fishing fleet tends to range far into the waters east of China to offset depleted stocks closer to shore.

Windows 8 Complaints App Removed from Windows Store

Microsoft has had a change of heart concerning complaints directed back at Microsoft concerning Windows 8. Several weeks ago Microsoft granted permission for the Complaint App to be included in the Windows Store for download. The App has been removed without explanation.

Well, it seems that something has changed since then, because today we noticed that the Windows 8 Complaints app was no longer available for download from the Windows Store.

Israel court overturns ban on Arab politician

JERUSALEM: Israel's Supreme Court ruled on Sunday an Arab lawmaker could stand in elections, overturning her disqualification by electoral officials over her participation in a Gaza-bound aid flotilla in 2010.

The nine-justice court ruled unanimously Haneen Zoabi "shall be a candidate for the Knesset" in a Jan. 22 poll without giving details of its reasons.

Zoabi drew widespread criticism in Israel for taking part in an international aid flotilla that challenged the Israeli blockade of the Gaza Strip, territory ruled by Hamas Islamists opposed to the existence of the Jewish state.

She was on the Mavi Marmara when Israeli naval commandos raided the Turkish vessel in May 2010, killing nine Turks in clashes with activists on board.

The Central Elections Committee voted on Dec. 19 to disqualify Zoabi, saying she had shown "support for an enemy state or terrorist organisation engaged in armed conflict against Israel".

Zoabi has said she had no role in any of the violence on board the Mavi Marmara and had tried to mediate between the sides during the raid.
